# Terms of Service

These Terms of Service (“Terms”) govern your access to and use of shopgoldenfire.com (the “Site”) and purchases from Ice On Fire Jewelry Inc., doing business as Golden Fire (“Golden Fire,” “we,” “us,” or “our”).
By visiting the Site, creating an account, submitting information, or purchasing a product, you agree to these Terms. If you do not agree, do not use the Site.
## 1. Eligibility
You must be at least the age of majority in your state of residence to place an order. A parent or legal guardian may place an order on behalf of a minor.
You may not use the Site or our products for an unlawful or unauthorized purpose.
## 2. Customer Accounts
You may be able to access order history, returns, and other features through a customer account.
You are responsible for:
- Providing current and accurate information.
- Protecting access to your email and verification codes.
- Informing us promptly if you believe your account has been accessed without authorization.
We may restrict account access when reasonably necessary to protect customers, the Site, or Golden Fire.
## 3. Product Information
We make reasonable efforts to display and describe our jewelry accurately, including available gold purity, dimensions, finishes, stones, chain options, and other product details.
Colors and appearance may vary depending on lighting, photography, screen settings, and natural material characteristics. Review the complete product description and selected options before purchasing.
Product availability, specifications, packaging, and designs may change. We will not substitute a materially different product without informing you and giving you an appropriate option.
If a product is personalized or engraved, you are responsible for reviewing the submitted spelling, initials, dates, and other customization details before completing the order.
## 4. Prices and Promotions
Prices are displayed in United States dollars unless stated otherwise.
We may change prices before an order is placed. Price changes do not affect completed orders unless the displayed price resulted from an obvious error.
If we discover a material pricing, discount, availability, or product-information error after you order, we may contact you for instructions or cancel the affected item and issue a refund.
Promotions, discount codes, and special offers may have separate eligibility requirements and expiration dates. Unless expressly stated, offers cannot be combined.
## 5. Orders and Acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean the order has been accepted.
We may refuse or cancel an order for legitimate reasons, including:
- Product unavailability.
- Pricing or listing errors.
- Payment authorization failure.
- Suspected fraud or unauthorized activity.
- Shipping restrictions.
- Violation of these Terms.
- Orders that appear intended for unauthorized resale.
If we cancel a paid order, we will issue an appropriate refund to the original payment method.
## 6. Payment
You agree to provide accurate billing and payment information and authorize the applicable payment provider to charge the total shown at checkout.
Payments are processed by Shopify and third-party payment providers. Golden Fire does not receive or store your complete payment-card number.
You are responsible for applicable taxes, duties, or other charges shown at checkout.
## 7. Shipping and Delivery
Golden Fire currently ships only within the United States. Processing times, carriers, delivery estimates, tracking, and procedures for missing packages are explained in our [Shipping Policy](https://shopgoldenfire.com/policies/shipping-policy).
Delivery dates are estimates and can be affected by USPS, weather, holidays, incorrect addresses, and other events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after processing begins.
## 8. Returns and Refunds
Return eligibility, return deadlines, shipping costs, inspections, and refunds are governed by our [Return and Refund Policy](https://shopgoldenfire.com/policies/refund-policy).
A return request does not guarantee approval. Returned products must satisfy the conditions disclosed in the Return and Refund Policy.
Nothing in these Terms limits rights that cannot legally be waived, including applicable rights concerning defective, damaged, incorrectly described, or incorrectly shipped merchandise.
## 9. Reviews and Customer Content
If you submit a review, photograph, comment, suggestion, or other content to Golden Fire, you confirm that:
- You created it or have permission to share it.
- It is truthful and reflects your genuine experience.
- It does not infringe another person’s rights.
- It does not contain unlawful, abusive, deceptive, or malicious material.
You grant Golden Fire a nonexclusive, worldwide, royalty-free license to display, reproduce, format, and distribute submitted content for operating and promoting Golden Fire, subject to applicable privacy and endorsement laws.
We may moderate or remove content that violates these Terms, but we are not required to publish every submission.
## 10. Acceptable Use
You may not:
- Use the Site for fraud, unlawful activity, or infringement.
- Submit false payment, identity, shipping, return, or review information.
- Attempt to gain unauthorized access to the Site or another customer’s account.
- Introduce viruses, malicious code, automated scraping, or disruptive technology.
- Interfere with the security or normal operation of the Site.
- Copy, reproduce, resell, or exploit Site content without permission.
- Use Golden Fire branding in a way that falsely suggests sponsorship or affiliation.
We may suspend access or cancel affected orders when reasonably necessary to address prohibited activity.
## 11. Intellectual Property
The Site and its text, photographs, graphics, logos, product designs, videos, branding, software, and other content are owned by or licensed to Golden Fire and are protected by applicable intellectual-property laws.
You may use the Site for personal, noncommercial shopping purposes. No other license is granted without our written permission.
Third-party names, trademarks, payment logos, and service marks belong to their respective owners.
## 12. Third-Party Services and Links
The Site uses third-party services, including Shopify, payment providers, USPS, analytics providers, and advertising platforms.
Third-party websites and services are governed by their own terms and privacy practices. Golden Fire is not responsible for content or conduct controlled solely by an independent third party, except where applicable law provides otherwise.
## 13. Privacy

By using the Site, you acknowledge that information may be processed by Shopify and other service providers as necessary to operate the store, process payments, fulfill orders, prevent fraud, provide customer service, and perform other disclosed purposes.
## 14. Electronic Communications
You consent to receive transactional communications electronically, including order confirmations, shipping updates, return notices, account verification messages, and policy notices.
Marketing communications are sent according to your preferences and applicable law. You may unsubscribe from promotional emails using the link included in those messages.
## 15. Site Availability
We aim to keep the Site available and accurate, but uninterrupted or error-free operation cannot be guaranteed.
We may update, suspend, restrict, or discontinue Site features when reasonably necessary for maintenance, security, legal compliance, or business operations.
## 16. Disclaimer of Warranties
To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not guarantee that the Site will always be uninterrupted, secure, or free from errors.
Products remain subject to any written warranties, product promises, and consumer protections that apply to the purchase. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
## 17. Limitation of Liability
To the fullest extent permitted by law, Golden Fire will not be liable for indirect, incidental, special, punitive, or consequential damages arising solely from use of the Site.
For claims relating to a product or order, Golden Fire’s aggregate liability will not exceed the amount paid for the product giving rise to the claim, unless applicable law requires a different remedy.
These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury, violations of non-waivable consumer rights, or any liability that cannot legally be limited.
## 18. Indemnification
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person’s rights.
This section does not require a consumer to indemnify Golden Fire for Golden Fire’s own negligence, misconduct, or legal violations.
## 19. Events Outside Reasonable Control
Golden Fire is not responsible for delays caused by events outside its reasonable control, including carrier interruptions, severe weather, natural disasters, labor disputes, government actions, widespread service outages, or other emergencies.
We will make reasonable efforts to communicate material delays and provide remedies required by law.
## 20. Governing Law and Courts
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Subject to any consumer right to bring a claim elsewhere, disputes relating to these Terms or purchases from Golden Fire may be brought in the state or federal courts located in Los Angeles County, California.
## 21. Severability
If any provision of these Terms is held unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
## 22. No Waiver
Failure to enforce a provision of these Terms does not waive our right to enforce it later.
## 23. Changes to These Terms
We may update these Terms to reflect changes in our services, operations, or legal obligations.
The updated Terms will be posted on the Site with a revised effective date. Changes apply prospectively unless applicable law requires otherwise.
